Vape Vending Laws Around Placement, Access, and Age Verification

There is a federal law that makes it illegal to sell Electronic Nicotine Delivery Systems (ENDS) to anyone under the age of 21.  Most state laws have adopted the 21+ rule, but there are some states that have 18 as a minimum age for vaping.  It is important that Vape Vending operators are aware of these age-restrictions, but it is also important, and often-overlooked, to understand state laws concerning the placement and access of vending machines that sell or vend nicotine-containing vapor products.  Most states have not amended their statues to address age-verification technology let alone biometric verification measures, and although these measures may mitigate risk and reduce the occurrence of selling to underage, it is important to note that it does not necessarily make them compliant.  Hence, consult your attorney and review state laws regarding the placement of vape vending machines.
