Placement Restrictions
Under Idaho Code § 39-5706 (2025):
“No vending machine that dispenses tobacco products [which includes electronic smoking devices] shall be located in any place accessible to minors under 18.”
“On and after January 1, 2020, it shall be unlawful to sell or distribute tobacco products or electronic smoking devices from vending machines or self-service displays.”
Exception:
Stores are exempt from the ban on vending machines if at least 75% of merchandise consists of tobacco or electronic smoking devices, minors are prohibited, and this restriction is clearly posted on all entrance doors.
Retail License Requirements
You must be licensed as a retailer to sell vapor products or electronic smoking devices. The following applies:
- Retailer License: Required under Idaho Code § 39-5704(1).
- Delivery Sales Permit: If conducting online or delivery sales, see § 39-5718(1).
Taxation
There is no separate excise tax on vapor products in Idaho as of the latest 2025 review. However, standard sales tax applies and must be collected if you are selling directly to consumers.

There is no specific format mandated in the statute, but signage must be visible and clearly posted if machines are permitted under the retail exemption.
Product Packaging & Delivery
- All electronic smoking devices must be sold in manufacturer-sealed packaging.
- Shipment of vaping products must include a statement prohibiting shipment to those under 21 under Idaho Code § 39-5715.
