Current Kansas Laws on Vape Vending Machines

As of 2025, Kansas state law prohibits the sale of electronic cigarettes and vapor products through vending machines. Only standard cigarette packs may be legally sold via such machines. Products like cigars, smokeless tobacco, and e-cigarettes are excluded.

Furthermore, all tobacco vending machines must be placed in 21+ restricted areas, such as adult-only bars, clubs, or employee-only rooms. Currently, Kansas has only 57 licensed cigarette vending machines statewide.

Pending Legislation – House Bill 2094 (2025)

Introduced in early 2025, House Bill 2094 proposes the legalization of e-cigarette and vape product sales through vending machines. If passed, the bill would allow machines to dispense vapor products only in age-restricted environments, such as 21+ bars and nightclubs.

This initiative was spurred by a Topeka businessman aiming to expand vape product accessibility in adult-oriented venues.

Arguments in Favor of HB 2094

Supporters advocate for increased adult convenience, especially in nightlife venues. They highlight that modern vending machines utilize advanced age verification systems and can be securely limited to adult-only locations.

Advocates argue this approach respects adult choice while maintaining compliance with underage tobacco access laws.

Public Health Opposition

Organizations like the American Lung Association, American Cancer Society, and Tobacco Free Kansas Coalition oppose HB 2094. They express concern that vending machines, regardless of location, may increase youth exposure and undermine efforts to reduce nicotine access points.

Compliance Requirements (If HB 2094 Passes)

If House Bill 2094 is enacted, operators must adhere to strict compliance regulations, including:

  • Obtaining a Kansas vending machine operator’s license and a permit for each individual machine.
  • Installing machines only in 21+ adult-only areas.
  • Equipping machines with robust age-verification technology (e.g., ID scanners).
  • Ensuring only legal products are sold—excluding flavored vapes or unapproved FDA items.
  • Including all required health warnings and Kansas-compliant labeling on packaging.
  • Collecting and remitting all applicable state and local taxes, including e-liquid excise taxes.
